Terms of Use for AutoMessenger

AutoMessenger is a technical application provided by JUST IN CAST GmbH, Moselstr. 4, 50674 Cologne, Germany, email: info@justincast.de.

These Terms of Use govern AutoMessenger as a technical connection between the JustInCast platform and communication services, in particular the WhatsApp Business Platform. They supplement other agreements with JUST IN CAST where AutoMessenger is used to provide those services.

AutoMessenger supports automated and technically assisted business communication in connection with casting, placement, profile and platform processes provided by JUST IN CAST.

This may include casting requests, availability requests, reminders, schedule changes, booking information, cancellations, and account or profile information sent through supported communication channels.

AutoMessenger may process technical sending, delivery, read and failure statuses in order to verify proper transmission and the operational reliability of communications.

AutoMessenger is not a standalone public messaging service and does not replace the WhatsApp Business App or other communication services.

For communications via WhatsApp, AutoMessenger uses the WhatsApp Business Platform and the technical interfaces and services made available for it by Meta and WhatsApp.

Use of these services is additionally subject to the then-current terms, policies and technical requirements of Meta and WhatsApp, including the terms and messaging policies applicable to the WhatsApp Business Platform.

AutoMessenger functionality may depend on the availability, approval and technical design of services provided by Meta and WhatsApp.

AutoMessenger may only be used for lawful business communications related to services provided or supported by JUST IN CAST.

Messages that are unlawful, misleading, prohibited by law or not permitted under applicable platform policies must not be sent through AutoMessenger.

Operational communications relating to existing or prospective casting, placement, booking, profile and account processes may be sent as part of the relevant service.

Marketing communications are sent only where the applicable legal requirements are met and, where required, valid consent has been obtained.

JUST IN CAST seeks to provide AutoMessenger reliably but does not guarantee uninterrupted or continuous availability.

Changes to or restrictions of third-party services and interfaces, in particular those provided by Meta and WhatsApp, may affect AutoMessenger functionality.

JUST IN CAST may modify, restrict or discontinue individual AutoMessenger functions for technical, security, legal or operational reasons.

Where AutoMessenger processes technical delivery and communication data, it does so only to the extent required for the relevant function, security and traceability.

JUST IN CAST cannot guarantee uninterrupted availability for disruptions or restrictions caused exclusively by third-party services, networks or interfaces outside the control of JUST IN CAST.

Otherwise, statutory liability provisions and any supplementary contractual agreements with JUST IN CAST apply.

JUST IN CAST may amend these Terms of Use where required due to technical, legal or functional changes. The current version will be published on this page.
